If you download or distribute copyrighted materials using EKU's Internet connection, you are at risk to face judicial sanctioning or appropriate disciplinary action including loss of Internet privileges and possible criminal/civil action for intellectual property theft. EKU has recently been notified by Warner Brothers, a division of Time Warner Entertainment Co. (mediaforce.com), Business Software Alliance (www.bsa.org) and Twentieth Century Fox Film Corporation (mediaforce.com) that users of our network are pirating software, music and movies using peer-to-peer software including, but not limited to, Kazaa and Morpheus. The transmission or storage of all reproduced, distributed, altered, enhanced and/or manipulated copyrighted material must have the prior written permission of the copyright holder. Downloading or distributing in the absence of a license is a violation of the copyright which can subject you to prosecution by these entities. If ITDS is notified that your account is engaging in unauthorized activities, your Internet connection will be immediately disabled. For students, the claim will be forwarded to Student Judicial Affairs for adjudication. For faculty or staff, the claim will be forwarded to the Computing and Communications Ethics Committee for review and recommendation on appropriate disciplinary action. If the violations continue, you are at risk of losing your internet connection through EKU permanently and you may face further administrative penalties up to and including expulsion from the university or termination of your employment as well as criminal/civil penalties.
